Judge refuses recusal

Industrial Court Judge Tebogo Maruping has dismissed an application for his recusal in the case between the public sector unions and the Director of Directorate of Public Service Management.

He said the view formed for his recusal was devoid of merit and should be dismissed. This came after an application by the unions' attorney Tshiamo Rantao on basis upon which the application was made as gleaned from an affidavit by Andrew Motsamai, President of the Botswana Public Employees Union and the Secretary General of the Botswana Federation of Public Sector Unions.

In his affidavit Motsamai had said that since the inception of the matter on April 26, 2011 Maruping had been reluctant to afford the unions their constitutional and natural right to be given adequate, sufficient or reasonable opportunity to present their case.
