Judge recuses herself from case she committed for trial

FRANCISTOWN: The former Acting Director of the Department of Public Prosecutions (DPP) who is now a judge in the Francistown High Court, Phadi Grace Solomon, has recused herself from an attempted murder case because she was the one who signed it for trial.

Having signed the notice herself meant she believed there was a prima-facie case against the accused, Justice Solomon averred. This was after the first prosecution witness, who is the complainant in the matter, gave his evidence in chief. Justice Solomon said she had not been aware of the situation until it was brought to her attention during recess.

"It was brought to my attention during the adjournment that the trial notice was signed by myself while I was still at the DPP," Justice Solomon explained as the court resumed. "For that reason, I cannot continue with this matter and would rather I referred it to another judge." Meanwhile, the prosecution witness that had already given evidence before the judge recused herself told the court that Boitatlhelo Moatlhodi (46) had shot him with a rifle in the buttocks in 2006.
