Judge quashes misguided prosecution

FRANCISTOWN: Justice John Mosojane has dealt a serious blow to the state when he ordered that it is 'harassment' for the state to bring Ipopeng councilor, Interest David Tawele to court when there is no charge against him.

Justice Mosojane ordered that until the state has established a prima facie case against the applicant and formally charged Tawele, the applicant has no reason to attend the magistrate's court.

"I also order costs against the respondents on the scale as between attorney and own client jointly and severally the one paying the other to be absolved," Justice Mosojane ordered. Tawele had instructed Phadza Kgalemang a managing partner at Kgalemang and Associates to challenge senior magistrate Peggy Madandume's order directing him to attend mention for a 'non-existing charge' following the death of a 12-year-old boy last year.
