Judge dismisses rape appeal

FRANCISTOWN: Justice Mphaphi Phumaphi has dismissed a rape appeal against conviction and sentence on merit regardless of his finding that the trial magistrate had relied on hearsay.

The appellant Ditsheko Phikwe of Nata was convicted and sentenced to 10 years for a rape that took place on August 3, 2004 in Nata.

In his judgement, Justice Phumaphi noted that Phikwe appealed against his conviction and sentence because he had not been furnished with witnesses' statements, among other reasons.
