Judge calls non-state actors to action

Non-state actors and the critical mass of people who are aggrieved by gaps in the legal protection of their rights have been urged to fulfil their electoral responsibilities by taking the State to task, Justice Annah Mathiba of the Industrial Court has said.

She stated that even though rights are enshrined in the constitution, it is the duty of the State to respect, protect and fulfil them.

During a presentation at the Botswana Network on Ethics, Law and AIDS (BONELA) annual general meeting, Mathiba expressed concern that stigmatisation continues to be a challenge in HIV/AIDS war and should be nipped in the bud. She pointed out that it is clear from a judicial position that as a country, Botswana does not have adequate means to protect people from HIV related discrimination as per the cases heard at the Industrial Court.
