It's Friday for Motswaledi

The Court of Appeal has said it will deliver judgment this Friday in the case in which Botswana Democratic Party (BDP) secretary general, Gomolemo Motswaledi, is appealing a High Court decision to dismiss his application to have his suspension by President Ian Khama set aside. A special session of the court heard the appeal on Tuesday in Lobatse.

At the half-day hearing before a five-judge panel of NJ McNally acting as Judge President, JG Foxcroft, Mathealira Ramodibedi, CT Howie and Seth Twum, it was obvious that the two Senior Counsels, Advocate Roland Sutherland for Motswaledi and Eduard Fagan for Khama had upped the ante knowing that this was the final pitch.

When he stood to address the court, Sutherland had to contend with preliminary issues.He stated that even if the court finds that their appeal could not succeed against Section 41 of the Constitution, it will be wrong to move along the premise that the rest of their case should not be heard. He said Motswaledi could still be the candidate for Gaborone Central parliamentary seat. In fact, he stated that if they were to succeed in their appeal, they will approach the Independent Electoral Commission (IEC) to allow Motswaledi to contest.
