Inmate Loses Court Bid To Vote

Justice Key Dingake of the Lobatse High Court has dismissed a landmark case in which a Gaborone prisoner, Thomas Sibanda wanted the Independent Electoral Commission (IEC) to be ordered to allow him to vote.

In dismissing the application, the court ruled that Section 6 of the Electoral Act, which bars prisoners from voting, did not contradict the country's constitution.

In his application, Sibanda wanted the court to order that certain sections of the Electoral Act, which bar prisoners from voting, are ultra vires some provisions of the Constitution.
