Incestuous uncle denied appeal

FRANCISTOWN: A 25-year-old man, who was convicted of defilement after impregnating his 12-year-old niece has been denied leave to apply for permission to appeal.

Johann Moruisi engaged in a back and forth debate with Justice Mpaphi Phumaphi while trying to convince the court that he deserved a chance to appeal. He appeared before the Judge last week.

Phumaphi dismissed the application, stating that the applicant failed to show reasons that he would succeed at appeal, as he had agreed to some and failed to challenge some at the trial court. The judge said that the applicant had defiled his own niece, hence Section 147 sub section 16 that he (the applicant) had quoted did not apply to him.
