Incest suspect fails to get bail

FRANCISTOWN: A 59-year-old father charged with incest has been denied bail because of a report from the social welfare department yesterday. Kemoiponetse Mosweu has been told by chief magistrate Lorraine Makati-Lesang that he can appeal the decision to deny him bail at the High Court. "After I read the report, I could not give you bail.

The court has advised you that you can appeal at the High Court because this court has made its decision," she said.  Makati-Lesang said that the court will give the suspect the ruling so that he could appeal to the High Court. Mosweu has been trying to get bail since last year when he was arrested for allegedly having sexual relations with his two daughters at Mabesekwa Village. One of the daughters is said to be a juvenile, while the other is over 18 years. The social welfare report discouraged the court from giving the accused bail because he stays with his daughters in the same yard, which means that he can influence them. Mosweu said the magistrate should have told him that he should apply to the High Court when he received a compilation of the ruling from the magistrate.

Meanwhile, the state has been forced to withdraw a case against a suspect who has been missing for a year. Kite Christian, 30 of Tonota Village is said to have absconded during trial in 2007 when he was supposed to put up a defence. Christian was facing a single count of defilement after allegedly engaging in sexual intercourse with a 14-year-old girl.
