Hukuntsi Magistrate sues accused for complaining

Hukuntsi Magistrate Dumisane Basupi is suing a man who previously appeared before him for a traffic offence he is alleged to have committed in Kang Village.

Basupi claims that Obonye Monamati damaged his reputation as well as his dignity by writing to his superiors, complaining about his conduct. He further claims that the defendant defamed his character with the complaints he filed.Basupi, who is self represented in the case submitted before court, has ordered that the defendant pay P150,000 for the defamation caused to him by the letter.

He also submitted that the defendant be ordered to pay him an extra amount of P150,000 for impairment of his dignity and personality. He further asks the court to order the defendant to pay for the legal costs of the matter.Basupi said the letters that were written to his superiors may indicate that he is not suitable for the magistrate job, and as such, may hinder his career progress. He also claims that the defendant "was not complaining but tarnishing his name".
