High Court to hear Seretse case next week

The DPP has appealed to the High Court challenging a decision by Gaborone Regional Magistrate Barnabas Nyamadzabo to allow defence lawyers for former Minister of Defence, Justice and Security, Ndelu Seretse to cross-examine a witness on the basis of a statement made by another witness, who is yet to testify.
The DPP vehemently argued that it was improper to allow such cross-examination as it was tantamount to hearsay evidence. On the other hand the defence team said there was nothing wrong in taking that route, as such evidence was already before court through a written statement. The arguments over the matter took at least three days, forcing Nyamadzabo to allow the DPP to approach the High Court for guidance on how to proceed.
