Govt sued over flogging death

SELEBI-PHIKWE: The Kalodi family is suing government for P130,000 after their 15-year-old son died after he was flogged for slapping another boy.

The Kalodi family has already served a statutory notice with the Attorney General's Chambers indicating their intention to sue government over the death of their son, Biki Kalodi. Kalodi of Tsetsebjwe died following four strokes at the local kgotla administered as corporal punishment for slapping another boy who was refusing to return his trousers after a soccer match. The boy died a week after receiving the strokes on his bare back administered by a passerby engaged by the kgosi. According to the papers served by Mosireletsi Legal Services, the Kalodi family is seeking compensation for bereavement of P100,000 for their son's unlawful and negligent death, reimbursement of P5,000 for expenses incurred through medical treatment for the boy as well as reimbursement of P25,000 for the boy's funeral expenses.

The statutory notice states that; "if a month elapses without the government paying the client as he demands, we hold firm instructions to assist the client to, through the legal insurance policy he holds with us, instruct a lawyer to commence civil action against the government without further notice to you or anyone concerned for High Court action for compensation." Other respondents in the case are Kgosi Selelo Ntwayagae, Constable Vusi Nkomo of Botswana Police and Rebaone Maphakela, an independent contractor.
