Fraud suspects application for discharge thrown out

FRANCISTOWN: High court judge Justice Mpaphi Phumaphi has thrown out an application by two fraud suspects, seeking an order against the Director of Prosecution.

The suspects also contended that their prosecution be permanently stayed and that they be discharged of all offences brought against them. Gabriel Ramoshi Kanjabanga, an attorney and Boitshwarelo Moreeng are facing charges of stealing a cheque worth P399 500 90 from the Southern District Council. Their first court appearance was at the Gaborone Magistrate Court in 2008.

The two argue that there has been an unreasonable delay in bringing them to trial. They said while they had been warned and cautioned in 2005, they were  only brought to trial in 2008. The applicants wanted the prosecution to be declared unconstitutional in that it violates their rights to be tried within a reasonable time, and fairly.
