Extradited Zimbabwean Refused Bail

FRANCISTOWN: Justice Thomas Masuku refused bail, pending trial, for a Zimbabwean man who was extradited from his country to face a charge of murder and theft of motor vehicle here.

The applicant, Hussen Musa, submitted that he had been kept in jail for 16 months without a trial date. Musa accused the state of not taking the provisions of Section 133 (2) of the Criminal procedure and evidence act (CPEA) seriously. State counsel, Careb Mbenda, on the other hand, acknowledged that Musa has been jailed for a long time. The youthful Mbenda submitted that the applicant was committed from the Magistrate's Court on September 6, 2007 and was indicted on September 18, 2007. "We had hoped the registrar would have placed the matter on the roll in February, 2008 which he has not," he said.

He applied for the court to order that the matter be placed on the roll for the next session in April.
