A State prosecutor in the Directorate of Public Prosecutions (DPP), Paper Molomo, has told the High Court that they advised the police to seize Daisy Loo's P25 million as exhibits in the on-going criminal investigation, but denied the DPP was in contempt of court in doing so.

Molomo argued that the DPP's hands were clean because they did not go to court to seek the restraining order. He was making a presentation in the Daisy Loo case that resumed in Lobatse on Friday. Molomo said after realising that the DPP had no powers to withhold the Daisy Loo funds as exhibit in their ongoing serious crime investigations, they advised the Commissioner of Police, who has such powers, to get the exhibits for the DPP, so they can be used as evidence in the on-going case. He said the money was the proceeds of a serious crime.

The exhibit refers to the P25 million the High Court of Appeal awarded Daisy Loo, which money had remained frozen in a neutral account over the last two years, pending the resolution of the marathon case.
