Deputy sheriffs in tug-of-war over 'debt'

An attachment dispute has pitted two messengers of court against each other, with the other one desperately fighting to save his property from being auctioned.

Gaborone deputy sheriff Cain Mogorosi, whose property was recently attached by another deputy sheriff Molebi Galeitsiwe, has filed an application with the High Court to stay the execution of the two vehicles.

Mogorosi found himself in the "matter between" after a Molepolole businessman Mompati Kgano took him to the cleaners.  According to court records, Mogorosi once attached and executed Kgano's cattle for a debt.  But Kgano filed a case with the High Court, complaining that the attachment was in excess of the P8,000 that he was owing.
The High Court has since made an order that Mogorosi should settle the outstanding order or his property should be attached for execution.  As a result, Galeitsiwe has attached two vehicles belonging to his company. But in a new development, Mogorosi, who is represented by Gaborone attorney Gabriel Kanjabanga is questioning the writ of execution granted against him by the High Court.
