Making his presentation before Justice Stephen Monametsi Gaongalelwe, Collins said on the same day as the Court of Appeal sat, the DPP prepared a notice of motion seeking declaratory orders against Daisy Loo.

Collins told the court that the effect of the orders sought by the DPP, had they been granted by Justice Newman, who was approached without the other parties cited on July 27, would have been to defy the orders of the Court of Appeal.
He argued that there was contraction in the DPP's reasons for seeking to withhold the payment awarded to Daisy Loo.
