Court to rule in Nchindo's case next Thursday

Gaborone Village Chief Magistrate Lot Moroka will next Thursday make a ruling on the application made by Nchindo's attorneys who want the state to furnish them with the key witnesses' statements.

Led by advocate Peter Hodes, defence lawyers contend that their clients' rights  are being prejudiced, as they are not afforded adequate information to conduct a  defence. The defence team wants statements from members of former president Festus Mogae's Cabinet.

Hodes told the court yesterday that a witness is someone who has been interviewed, a statement taken from and/or someone whose statement is taken has been called to give evidence. "So far we have written affidavits from the current Cabinet ministers - Margaret Nasha, Jacob Nkate, Pelonomi Venson-Moitoi and the former minister Boometse Mokgothu. According interpretation, these are the witnesses that the state can claim to have been in Mogae's Cabinet."
