Court throws out Mochudi complex owners' bid

The Lobatse High Court has dismissed an application in which Mochudi Wholesalers were challenging the Kgatleng District Council (KDC)'s decision not to grant them a certificate of occupation.

This is in respect of the three-storey shopping complex in Mochudi, which the company built in 2003.   But the complex has never been occupied since the council insists that the company contravened building regulations. 
The council has also found that the building has encroached onto a road reserve.

Recalling the facts of the case, Justice Steve Gaongalelwe said the essential requirement from the Roads Department was and still is that the building be in line with existing structures in the vicinity that is 15 metres from the road centre.
