Court orders car dealer to refund client

FRANCISTOWN: A Small Claims Court here on friday ordered a car dealer at Enoave (Pty) Ltd to refund his client after he failed to deliver on an order for a car.

According to particulars of the case, on May 15, 2012, Philimon Mandu of Area W location in Francistown went to the car dealer based at Bluetown location to buy a Toyota Corolla.Mandu first paid an installment of P4,000 and a second installment of P1,500 to the dealer on May 16, 2012. After paying the second installment, Mandu was given ownership of the car and the parties agreed that the dealer will keep the blue book of the car once the last installment of P1,000 was settled.

Mandu and the dealer agreed that the last installment should be paid within the next three months then.However, things took an ugly twist on July 30, 2012, when one Frank Moitshepi confiscated the car when he found Mandu driving it.Moitshepi produced an identity document and the car's blue book to prove ownership of the car.Mandu gave him the car and proceeded to the police to report the matter. The police advised him to seek help from the Small Claims Court since the matter was civil in nature.Passing judgment, magistrate Jennifer Chikate ordered the dealer to pay Mandu P5,500 plus costs without fail on or before February 28, 2013.
