Court hears MoE appeal against UB students

The matter between the Ministry of Education (MoE) and the University of Botswana's (UB) Student Representative Council (SRC) will go before Judge Maruping Dibotelo on Thursday after the SRC filed its heads of argument last Friday.

The students managed to pay P5 000 of the P20 000 deposit requested by their lawyer, Collen Mudara of Kanjabanga and Associates, last week so as to continue representing them after MoE appealed the first ruling by Judge Key Dingake. The students went around requesting for donations which totalled P5 000. The SRC also had a fundraising welcome event last Saturday from which they raised the remaining P15 000 which they were supposed to pay today.

The lawyer will argue that the applicants (MoE) have a binding agreement with the students for them to be paid their allowances as determined from time to time. In his heads of argument, Mudara says it is apparent that the ministry is clutching at straws and urges the court to enforce the terms of the contract as agreed by both parties.
