Court dismisses Motowane case

The Molepolole Magistrate Court last week dismissed stock theft charges against Botswana Democratic Party (BDP) Central Committee member, Maxwell Motowane.

The case was dismissed because the prosecution was stalling. The defence applied for the dismissal after the prosecution failed to turn up in court on time. The Kweneng-nominated councillor and BDP parliamentary candidate for Letlhakeng West, was charged with stealing five unbranded calves belonging to Joel Kereng. The state said the calves were worth P6,000. Motowane was initially remanded in custody, but was granted bail by the Lobatse High Court.

The prosecutor, Daniel Katse, told Mmegi that when the matter was called for mention, he was in another courtroom attending to another matter. He conceded that Motowane's case has been dismissed for want of prosecution. But he said the case has not been withdrawn by the state. He said it can still be re-registered. "We were supposed to type the docket and take it to our prosecution division. It will be registered very soon. The court should have given me time to respond," he said.
