Court defers triple murder convict's appeal

LOBATSE: Triple murder convict Gotlhalosamang Gabaokelwe will have to wait to know his fate after a panel of four Court of Appeal judges postponed the hearing of his appeal to the January session.

Gabaokelwe was last year convicted and sentenced to death by the Francistown High Court for the murder of his girlfriend and two children in cold blood in Borolong.On Friday, Gabaokelwe's attorney applied for the postponement saying that they received the case record late, so they did not have enough time to prepare.

Morolong, an attorney for Gabaokelwe and instructed by Duma Boko, told court that they only received the case record last week hence they were not in a position to fully argue the matter. Gabaokelwe, alias Xolilwe, was convicted of the murder of Keneilwe Ndolo, Ogomoditse Ndolo and Kaone Ndolo. It was alleged that Gabaokelwe murdered the trio on May 17, 2008 at Borolong after an argument over food with the 23-year-old Keneilwe who was his cohabitating girlfriend.
