CMS case: Defence lawyers want clients freed

LOBATSE: Ex-prosecutor Kgosietsile Ngakaagae and his former Directorate of Public Prosecution (DPP) colleagues were engaged in a battle of wits, as the P21 million Central Medical Stores (CMS) case reached the High Court on appeal yesterday.

Ngakaagae, who is working in concert with attorney Duma Boko, were on one side, while his former colleagues - Matlhogonolo Phuthego, Merapelo Mokgosi, Priscilla Israel and Mosweu Ditodi Tuesday - were in the opposite corner.

He and Boko want High Court judge Steven Gaongalelwe to overturn the decision of then regional magistrate, and now High Court judge Lot Moroka. They want their clients Norman Maja, Bushy Nthibo, David Tumagole, Patric Cole and Abram Marumo, who were convicted by Moroka, to be freed.  Speaking for Maja, Ngakaagae, who now works as a defence attorney, submitted that his client should be acquitted and discharged as the then presiding magistrate (Moroka) had failed to take into consideration the reasons given by Maja during trial.
