LOBATSE: A multi-million Pula building is lying idle because its owners and a local supermaket are embroiled in a legal battle at the Lobatse High Court.

The proprietors of the building at Gabane Junxion Mall, Mogobe Incorporated Limited, have lodged an urgent application before the High Court after a disagreement over the lease agreement entered into with Shoppers Supermarket. In the founding affidavit, the MD of Mogobe Inc, Lerumo Mogobe, says that subsequent to entering into the lease agreement which did not include specific finishes, Shoppers demanded that additional works be done and that this amounted to approximately P1,500,000.

"This was not acceptable to Mogobe Inc," Mogobe says. "The only specifications set out were in the preamble to the lease agreement which has been duly complied with. Eventually Mogobe Inc. cancelled the agreement." Mogobe is worried that should the court not come to their assistance, the damages they continue to incur will force them into  bankruptcy and closure.
