Lobatse High Court's Justice Matlhogonolo Phuthego has ruled in favour of Biggie Butale in a case in which he wanted the court to declare him the Botswana Patriotic Front (BPF) president.

Butale sought the court's intervention to declare his legitimacy as BPF president following his utterances to the effect of a resignation at a BPF National Executive Committee meeting, saying it was merely a threat he made in the heat of the moment. Following said threat to resign, Butale continued as party president. He even suspended members including Tshekedi Khama, Vuyo Yane Notha, Robert Mariba, and Prince Bosilong.

Tshekedi would then write to Butale asking him why he purported to be party president following his alleged resignisation. With two centres of power in the party, Butale then approached the court on urgency citing the four (Tshekedi, Notha, Mariba, and Bosilong), Patron Ian Khama, and NEC members backing Khama for the BPF presidency. Today's ruling also means the four remain suspended from the party.
