It appears that the law does not prohibit a paramount chief who does not preside over customary cases and does not run a tribal administration office from sitting in Ntlo ya Dikgosi.

A legal expert said yesterday that Section 77(1) (a) (viii) of the Constitution acknowledges that there are many functions of a Kgosikgolo or Paramount Chief. To disqualify one on the basis of not performing those functions would be unconstitutional, he said.

If this were to be the case, said the lawyer, then the Bogosi law would have to be amended.
