BOFEPUSU challenges appointment of Industrial Court judges

SELEBI-PHIKWE: Botswana Federation of Public Sector Unions (BOFEPUSU) has announced a statutory instrument meant to challenge the appointment of judges of the Industrial Court.

The federation argues that the judges are not appointed through the recommendation of the Judicial Service Commission (JSC). The federation hopes that if it wins the case, then all their cases tried by the Industrial Court would be nullified. BOFEPUSU official, Johnson Motshwarakgole, who was the guest speaker during the public service strike winding up party over the weekend, indicated that they have eight court cases against the government. He said they are challenging President Ian Khama's decision to deny workers a public holiday that comes a day after Independence Day. "Government at some point negotiated an out-of-court settlement on this one but later somersaulted," he asserted. Motshwarakgole said the case resumes in court on December 1, 2011.

He said that 700 civil servants who were dismissed from work for participating in the strike have not been reinstated. He announced that they hope to win the case in court since they have engaged advocates to challenge the fact that the sacked workers were not given a hearing before dismissal. He said the federation is trying everything within its power to assist those dismissed from work. He stated that so far, they have assisted the workers with P500 each.
