Basarwa borehole dries up

The Mothomelo borehole in the Central Kgalagadi Game Reserve (CKGR), that was at the centre of the court case between Basarwa and Government of Botswana has dried up, Mmegi has established.

A team of experts from Vox International went into the reserve to re-commission the borehole during the Easter Holiday but found that it has dried up, said one of the lawyers Seranne Junner, representing two Basarwa Matsipane Mosetlhanyane and Gakenyatsiwe Matsipane at the Court of Appeal.

The court of appeal ruled on January 27th, 2011 that the Water Act gives a legal occupant of a piece of land the right to draw water, either by sinking a borehole or otherwise, for domestic use. The Court of Appeal recognised Basarwa as legal occupants of the CKGR and hence they have that right to find a source of water for their survival.
