Alleged rapist to know his fate next week

FRANCISTOWN: Next Wednesday will be judgement day for a 24-year-old man accused of raping his under age cousin at Ramokgonami village, North East District.

Prosecutor Oaitse Selemogo, appearing together with acting principal prosecutions counsel Keneiloe Lephalo, stated that in this offence for the prosecution to be successful, it had to prove various elements.

It has to prove that sexual intercourse took place between the complainant and the accused person. It also has to prove that it took place without the consent of the complainant. The trial magistrate has to satisfy himself that the complainant is telling the truth and has to take an oath. Further, the complainant has to be admonished to determine whether she knows the difference between the truth and lies. It is our submission that in this case, the procedure was followed by the magistrate, submitted Selemogo.
