The battle belongs to Batswana

On Friday the nation woke up to the depressing news that the legal battle instituted by Gomolemo Motswaledi against his party president Ian Khama had come to a crashing ending.

The matter should have been just an internal party affair, but assumed national significance because it involved a sitting state President.By appealing his sudden suspension by Khama to the courts, Motswaledi inadvertently caused Khama to invoke a clause within the Botswana Constitution, which grants him immunity against prosecution.

The BDP secretary general's war therefore became a matter of public concern and for the first time forced Batswana to critically looke at the their Constitution. That Khama invoked presidential immunity to summarily dismiss Motswaledi's concerns regarding his suspension from the Botswana Democratic Party made many citizens stand up and scrutinise the import of this presidential immunity as provided for in the Constitution.
