Vicarious liability - Part 2

To recap, vicarious liability sits within the law of delict.  It is generally the strict liability of one person for the harm caused by another (to someone else).  It arises in several situations, one of which is an employer-employee set up.  Three requirements must be satisfied for it to arise in this context.  I will repeat the one requirement which I see as oft-times ending up being hotly contested.  This is whether the employee in question was indeed acting within the scope of his/her employment at the time that he/she committed the wrong (to someone else).  In this article, the last on vicarious liability, I seek to share what I regard as quite valuable lessons for learning.
