Settlement favours Botash in drawn-out case

The oldest case in the books of South Africa's competition authorities was finalised on Tuesday when American Natural Soda Ash Corporation (Ansac), a joint venture cartel of US soda ash producers, reached a settlement involving R9.7 million (approximately P7.7 million) with the country's competition commission.

In the settlement agreement confirmed by Botswana Ash (Botash) and the competition tribunal, Ansac admitted that its membership agreement had eliminated price competition between its members in export sales to South Africa,  which was in breach of the Competition Act.

Ansac also agreed to pay the legal expenses of Botash.The case was referred by the commission to the tribunal in 2000 after an investigation into a complaint of anticompetitive activity by Ansac was lodged by local soda ash producer Botash.
