Competition Commission grows teeth

The Competition Commission can now sit to determine cases brought before it following last week's publication of the rules for the conduct of adjudication proceedings in the Government Gazette.

In a statement released this week, the Competition Authority (CA) said that   the rules set out the procedures to be followed in the adjudication process and will assist those who come before the Commission.

The commission is a tribunal, which adjudicates or presides over complaints referred by the CA, with the most important part of its adjudicative process being the imposition of fines and /or remedies. The commission also gives general policy direction to the CA. Save for mergers and acquisitions, adjudication and rulings on competition issues are the province of the Commission.
