Why Land Tribunal dismissed Tsabong West farms case

The Land Tribunal has dismissed the case in which three people sought to overturn the allocation of farms in Tsabong by the Kgalagadi Land Board.

The tribunal dismissed the case filed by William Tikkie Matswiri, Edward Bojang and Richard White saying that it had no jurisdiction on the matter citing Section 25 of the Land Tribunal Act. It said the case cannot proceed because the appellants were seeking to challenge a common law decision of the Land Board made under Section 24.

The three had lodged an appeal on the grounds that the Kgalagadi Land Board allocated farms west of Tsabong without proper consultation. Other respondents in the case were Kgalagadi Sandunes Services Ltd, Animal Care Agency Board and Kgalagadi Tourism and Recreation Ltd
