Water Affairs duo go free as State delays

FRANCISTOWN: Presiding High Court Judge Terence Rannowane on Friday dismissed a case in which two former Water Affairs Department employees were each charged with misappropriation of government funds because the state delayed prosecuting the pair.

The court found that the delay by the state in prosecuting Baneisitswe Kebuang and Kgomotso Macheng was unreasonable and occasioned serious prejudice to the duo. Though the two were charged separately they filled a consolidated application through their attorney Wanano Lumbile seeking the court to grant a permanent stay of prosecution against them.

They decried that continuation of the case would amount to infringement of their right to a fair hearing within a reasonable time.  The state took nearly a decade to prosecute the duo for a single count of theft by servant.
