In his ruling, Justice Letsididi noted that Tsobane was not candid to the court when he said he met the deceased's mother a week before he committed the murder, who told him that he was stupid for supporting the child that was not his. This was because the deceased's mother had long since died in 2002. "In the circumstances, it is not clear why he was driven to commit the offence," the judge said.
Justice Letsididi said Tsobane was under legal obligation to maintain the deceased. "I am of the view that that he intended to rid of the problem once and forever by killing the deceased.
