The High Court:a complete mess

Amongst the many objects to which a free and intelligent people find it necessary to direct their attention is that of having an unhidden exercise of justice, and with it, the rendition of justice by sufficiently qualified independent individuals who have been appointed through a formula that is fair and transparent.

The supposition that justice must not only be done but must also be seen to be done is very vital and must never be treated with disdain. This maxim provides the best recipe to maintaining a corrugated judiciary that inspires public confidence.

In light of recent events, many of us will readily supply advocacy to the idea that the High Court faces the real danger of losing public confidence, if it still retains any. The unqualified and yet saddening idea that the High Court is not independent anymore can be made, without going through the trouble of a sifting search for hair-splitting exceptions. Naturally, there are some who hold this supposition to be the engine of a hyperbole, those who, instead, opt to rest content on the contrary soothing illusion. Let them be.
