The Gaborone High Court has thrown out the conviction of four Gaborone City Council employees alongside that of Daisy Loo Botswana and its managing director, Moemedi Dijeng.

Should the state wish to reverse this outcome, the matter would go to the Court of Appeal which has already ruled in a civil matter that Daisy Loo did nothing wrong. Justice Singh Walia said as much when he set the men free."I must find therefore, as I do, that there was no attempt to obtain by false pretences. Work was authorised by the council and was performed to its satisfaction. In the result, the conviction on this count also stands to be quashed.In the final result, all convictions entered by the learned magistrate are quashed and the sentences set aside," Walia says in concluding his 94-page judgement.

The learned magistrate, Barnabas Nyamadzabo, is now a learned judge and he handled the matter when he was still at the Gaborone Regional Magistrate Court. The accused persons are Frank Molaletsi, Gilbert Sithole, Frank Stegling, Sadi Abbey and Moemedi Dijeng who was charged along with his company, Daisy Loo Botswana. The charges were conspiracy to defraud GCC, obtaining by false pretences and giving false information to a public official.
