Mothusi appeals conviction

Convicted fraudster and prominent criminal lawyer Lyndon Mothusi has appealed his conviction by the Village Magistrates Court on the grounds that a defence witness had pressurised prison warder Akofang Moasetso to change his story.

Lyndon Mothusi and Hebert Sikhakhane, another lawyer, were recently convicted of financial crimes involving fraud and money laundering. It is alleged the crimes were carried out between October 2003 and January 2004 when the two defrauded the Botswana government of around P1million using falsified cheques and fictitious companies and individuals. The two were also convicted of attempting to defraud Botswana Life Insurance Limited (BLIL) and the Motor Vehicle Accident Fund (MVAF).

However, in his application to appeal filed with the High Court, Mothusi's lawyer Themba Joina argues that the Deputy Registrar and Master of the High Court Nelson Bopa who convicted Mothusi and Sikhakhane, while still a magistrate, had erred and misdirected himself in finding that the prosecution had proved its case.
