Man ordered to pay brother value of house

FRANCISTOWN: The high court has ordered a man to pay his brother the value of a 'two and half' house from their deceased father's estate.

Passing judgment this week, Justice Mpaphi Phumaphi ordered that, "The respondent is to pay the applicant the value of the house commonly referred to as a 'two and half' which was left incomplete by their father on plot 8651 when he died."

He also directed that the house be rated by a property valuer and that the cost be borne by the respondent. "Should the respondent fail to comply by the two orders, the applicant shall be entitled to engage an estate agent to value the house, and recover the value of the house as well as the cost of the agent from the respondent in terms of his judgment," Phumaphi added.
