Man loses two plots to Phakalane Estates

The Court of Appeal has ruled that Phakalane Estates can repossess two plots after the owner failed to develop them within four years.

Samuel Mpaesele has been found to be in breach of a condition of title deed that requires the purchaser to erect on the property a single family residential building.

The crux of the appeal was on whether the public notice published in the Government Gazette of April 17, 2003 was sufficient for the purposes of triggering the running of the four-year period Mpaesele was expected to develop the properties.  The public notice read: "Be pleased to take notice that the infrastructural development for Phase 3, 4 and the Gold Estate in Phakalane, Gaborone are now complete".
