Kenyans fail to get bail in P15m case

Two Kenyans accused of obtaining millions from local banks through false pretences were denied bail yesterday in Gaborone by Chief Magistrate Linah Mokibe-Oahile. Elinah Kemunto Zabulon Tai and Walter Mogi failed to regain their freedom though compatriot Maureen Njeri Muiruri and a Motswana co-accused Tshepo Apadile were granted bail in the P15 million case.

The four face eight counts of obtaining the money by false pretences from different banks. The defendants were arrested by the Directorate of Intelligence Services (DIS) on March 29. Tai and Mogi will stay in remand until Tuesday next week when the magistrate will deliver a ruling in their bail application, which was opposed by the state.

The prosecutor, Susan Mangori told the court that they are opposing bail because the two are a flight risk yet Botswana does not have an extradition treaty with Kenya. She said that if the two jump bail, it will become almost impossible to extradite them to Botswana to face trial. Mangori told the court that just a day before their arrest, Tai was about to flee the country.
