Habitual thief denied bail

FRANCISTOWN: Justice Zibani Makhwade has summarily dismissed an appeal by a habitual criminal he termed 'un-rehabilitable' as he has been given many chances to reform and many lenient punishments but always went back and committed crime.

When dismissing the appeal by Uyapo Ncube, Makwade said that he would give his reason at the next sitting.Ncube, who is currently serving 10 and three years concurrent sentence for theft, appeared before Makwade on Thursday to argue his appeal. His reasons for appealing were that he is sick and that he will never commit crime again. But Justice Makhwade retorted: "Everything that could be done to reform you has been done but you always go back and commit crime and you seem to be getting worse by the day.

"Leniency has been exercised on you over and over again. You must be very good at begging for mercy."Makhwade further asked the appellant why he should be afforded all this leniency and mercy and treated with kid gloves when he is not willing to change.
