FRANCISTOWN: Lawyers representing ousted mayor, Ephraim Maiketso are to serve the Francistown City Council (FCC) with a notice of intention to sue, Mmegi has established.

Maiketso is fighting to be reinstated to his mayoral position after he was stripped off his mayoral chain in September last year through a motion of no confidence by councillors of the ruling Botswana Democratic Party and the Botswana Movement for Democracy (BMD).The Botswana Congress Party (BCP) Francistown Central councillor wrote a letter last month demanding reinstatement by the FCC following the landmark Court of Appeal (CoA) ruling that declared that no city council in the country has the powers to remove a mayor from office through a motion of no confidence.

The city council has refused to grant Maiketso's wish to be reinstated in his position as well as repaying him the money he lost when he was relieved off his duties more than five months ago. The city council believes that Maiketso sat on his rights for too long. Now Maiketso is taking court action against the FCC. A Francistown lawyer representing the former mayor confirmed yesterday that they will be giving the FCC a notice of their intention to sue today."The city council has refused to comply with our demands (to reinstate Maiketso) so we are definitely suing them.  "We will give the city council our letter of intention to sue tomorrow (Friday).
