Family fights son-in-law over plot

FRANCISTOWN: A Serowe father has led evidence that his son-in-law is trying to fleece his son out of his plot in a divorce case before the Francistown High Court.

Gogosha Nathaniel, aged 83, told the court that before his daughter, Nametsego Gogosha got married he had put his son, Gaolomeletse Gogosha's plot under her name because he was still too young to be allocated the property.

However, Mopati Onamile who is now in the process of divorcing Nametsego told the court that the plot belongs to his wife. He argued that the family is simply plotting to deny him his right to benefit from their matrimonial property. Nametsego, her father and her siblings have all given evidence in a bid to convince the court that the plot cannot be part of the estate that is to be shared by the divorcing couple. In his evidence-in-chief, Nathaniel told the court that in 1996 he made a decision to sub-divide his plot among his sons. "I applied in 1996 and the land board told me that my youngest son Gaolomeletse would not be allocated a plot because he was underage, and also advised me that we could appoint someone to hold the plot for him which is why I chose his sister who was of age and at that time not married," he said. The octogenarian told the court that the plots were officially allocated in 1997 and his son's plot was in his sister's name. He went on to say that in 1999, he and another one of his sons, Gogosha Nathaniel, started developing the plot on behalf of the owner because he was unemployed at the time. "In 2003 he took over the building as he was now working and completed the house. He now resides there," said the father.
