Ex-BONELA employee sues for unlawful dismissal

The Botswana Network on Ethics, Law and HIV/AIDS (BONELA) has been hauled before the Lobatse High Court for unlawful dismissal, by Pako Luke.

Luke, was fired on November 21, 2011 for allegedly stealing from the organisation and using a cellphone belonging to the human rights advocacy body without authorisation.He was employed by BONELA at the beginning of February last year for a fixed period of two years as an assistant projects officer. Luke, who is represented by Dingake Law Partners, is asking the court to declare the termination of his employment null and void.

He claims that it was done without notice, hearing or justification and therefore was substantively and procedurally unfair. He also wants BONELA to pay him all salary arrears and benefits. He further demands that he be restored to the financial position he would have been in had BONELA not unfairly dismissed him. He wants the High Court to order BONELA to pay interest thereon at the rate of 10 percent per annum from November 21, 2011 to date. He demands that his former employer should meet the cost of his application.
