Essential service judgment today

The Court of Appeal is today expected to deliver judgment in the matter between public sector unions and the government over the legality of the 2011 strike by essential service employees.

The Court of Appeal could not deliver the judgment on February 1, 2013 due to the complex nature of the case and voluminous documents filed by both parties.  A panel of five judges comprising Court President Ian Kirby and Justices Isaac Lesetedi, Monametsi Gaongalelwe, John Foxcroft and Lord Alistair Abernathy heard the case.

Both parties employed high profile senior counsels from South Africa. Leading the arguments for the appellants was Advocate Anton Myburgh (SC) assisted by Advocate Tembeka Ngcukaitobi.
