DPP wants Kgafela locked up

The Directorate of Public Prosecutions (DPP) spent the whole day yesterday trying to convince Chief Magistrate Barnabas Nyamadzabo to put Kgosikgolo ya Bakgatla, Kgafela Kgafela, his deputy Bana Sekai and others behind bars pending trial.

Senior Prosecutor Kgosietsile Ngakaagae started the arguments saying it seems Kgafela, in his answering affidavit, purports to be representing other accused persons, something he said is unprecedented. The DPP is also against the defence team's request, led by Unity Dow, for the case to be referred to the High court when it is still at the Magistrate Court.

Ngakaagae said that the other accused persons have not opposed the application for remand and seem to be relying only on what Kgafela has said. He said they have also not stated anywhere that they have authorised him to speak on their behalf hence he cannot represent them while he is also an accused person. He said that for the accused persons, especially Kgafela, to claim ignorance of the charges he is facing with his regiments is made even more absurd by the fact that he wants the High Court intervention. Ngakaagae accused the defence of trying to hijack the system by rushing to the high court seeking it to close a case that still has to be decided at the Magistrate Court.
