Dingake-Marole appeal removed from the roll

The case in which Justice Key Dingake and Debswana managing director, Blackie Marole are challenging a High Court order that a litigant should be allowed access into their personal phone records has been excluded from the Court of Appeal roll.It is not known whether the matter has been bandoned or it will be resuscitated. The matter was to be heard yesterday but it emerged that it had been removed from the roll when the Court of Appeal session started.

Former employee of Debswana, Donald Gaetsaloe, who got the High Court order to access the mobile phone of the   phones of the two gentlemen said he was not aware that the case was not in the roll. He told Mmegi that he will consult his legal advisors on the matter. Later he said that he could not comment on an on-going case. Dingake, a judge at the High Court declined to comment on the removal of the appeal when contacted.

In the substantive case at the High Court, Gaetsaloe challenged his dismissal from Debswana and lost. He alleges that the High Court decision loss largely came because of what he claims to be an untoward relationship between Dingake and Marole. He claims in his appeal that he lost the case against his dismissal at the High Court because Marole bribed Dingake, the presiding judge with P1.5 million to rule in favour of Debswana.
